You have the right to obtain information about the origin, recipient, and intended use of your archived personal data at any time without incurring any fees. You also have the right to request the correction or deletion of your data. If you have consented to data processing, you have the option to revoke this consent at any time with future effect. In addition, you have the right to request that the processing of your data be restricted under certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. Please do not hesitate to contact us at any time if you have any questions about this or other data protection-related issues.

GENERAL INFORMATION AND MANDATORY INFORMATION

Data protection:

The operators of this website and its pages take the protection of your personal data very seriously. That is why we treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. When you use this website, various personal data is collected. Personal data is data that can be used to identify you personally. This privacy policy explains what data we collect and for what purposes we use it. We would like to point out that data transmission over the Internet (e.g. when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.

Information about the responsible party (referred to as the “controller” in the General Data Protection Regulation):

The data controller for this website is:

WE&ME Foundation
Eiswerkstraße 18
1220 Vienna
Austria

Name: Gabriele Ströck

Phone: [Upon request]
E-Mail: Datenschutz@weandmecfs.org

The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g., names, email addresses, etc.).

Duration of storage:

Unless a more specific retention period is specified in this privacy policy, your personal data will remain with us until the purpose for which it was collected no longer applies. If you submit a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., tax or commercial law retention periods); in the latter case, deletion will take place once these reasons no longer apply.

General information about the legal basis for data processing on this website:

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9 (2)(a) GDPR if special categories of data are involved in accordance with Art. 9 (1) GDPR. In the event of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49 (1)(a) GDPR. If you have consented to the storage of cookies or access to information on your end device (e.g., via device fingerprinting), data processing is also based on Section 25(1) TTDSG. Consent can be revoked at any time. Insofar as your data is necessary for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. If your data is also necessary for the fulfillment of a legal obligation, we process it on the basis of Art. 6(1)(c) GDPR. In addition, data processing may be based on our legitimate interest pursuant to Art. 6(1)(f) GDPR. Information on the respective legal basis in individual cases can be found in the following sections of this privacy policy.

Information on data transfers to the US and other non-EU countries:

Among other things, we use tools from companies based in the United States or other non-EU countries that are considered unsafe from a data protection perspective. When these tools are active, your personal data may be transferred to these non-EU countries and processed there. We must point out that a level of data protection comparable to that in the EU cannot be guaranteed in these countries. For example, US companies are required to disclose personal data to security authorities, and you as the data subject have no means of defending yourself in court. It cannot therefore be ruled out that US authorities (e.g., the Secret Service) may process, evaluate, and permanently archive your personal data for surveillance purposes. We have no influence over these processing operations.

Withdrawal of consent to data processing:

A large number of data processing operations are only possible with your express consent. You can also revoke any consent you have already given at any time. The legality of the data collection carried out until revocation remains unaffected by this.

Right to object to data collection in specific cases; right to object to direct marketing (Art. 21 GDPR):

IF DATA IS PROCESSED ON THE BASIS OF ART. 6(1)(e) or (f) GDPR, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation. THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. YOU CAN FIND THE LEGAL BASIS FOR DATA PROCESSING IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING OF YOUR DATA THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR THE PURPOSE OF THE PROCESSING IS TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR). IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING. THIS ALSO APPLIES TO PROFILING, INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority:

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State where they habitually reside, work, or where the alleged violation occurred. The right to lodge a complaint applies regardless of any other administrative or judicial proceedings available as a legal remedy.

Right to data portability:

You have the right to request that we provide you or a third party with the data that we process automatically on the basis of your consent or for the performance of a contract in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done if it is technically feasible.

Information about, correction, and deletion of data:

Within the framework of the applicable legal provisions, you have the right to request information about your archived personal data, its origin and recipients, and the purpose of processing your data at any time. In addition, you may have the right to correct or delete your data. If you have any questions about this topic or other questions about personal data, you can contact us at any time.

Right to restriction of processing:

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to request the restriction of processing applies in the following cases:

– If you dispute the accuracy of your data stored with us, we will usually need some time to verify this claim. During this verification process, you have the right to request that we restrict the processing of your personal data.

– If your personal data has been/is being processed unlawfully, you have the option of requesting that the processing of your data be restricted instead of deleted.

– If we no longer need your personal data and you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.

– If you have lodged an objection pursuant to Art. 21(1) GDPR, your rights and our rights must be weighed against each other. Until it is determined whose interests prevail, you have the right to request a restriction on the processing of your personal data. If you have restricted the processing of your personal data, this data may only be processed—with the exception of archiving—with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of other natural or legal persons or for important reasons of public interest cited by the European Union or a member state of the EU.

SSL and/or TLS encryption:

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the website operator, this website uses either an SSL or a TLS encryption program. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and the lock symbol appears in the browser line.

RECORDING OF DATA ON THIS WEBSITE

Server log files:

The provider of this website and its pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. The information includes: – the type and version of the browser used – the operating system used – referrer URL – the host name of the accessing computer – the time of the server request – the IP address This data is not merged with other data sources. This data is collected on the basis of Art. 6(1)(f) GDPR. The operator of the website has a legitimate interest in the technically error-free presentation and optimization of the operator’s website. To achieve this, server log files must be recorded.

Enquiries by email, telephone, or fax:

If you contact us by email, telephone, or fax, your inquiry and the resulting personal data (name, request) will be stored and processed by us for the purpose of processing your inquiry. We will not disclose this data without your consent, but will process it on the basis of Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the data will be processed on the basis of our legitimate interest in the effective processing of inquiries addressed to us (Art. 6(1)(f) GDPR) or on the basis of your consent (Art. 6(1)(a) GDPR), if this has been obtained; consent can be revoked at any time. The data you send us via contact request will remain with us until you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular statutory retention periods—remain unaffected by this.

Together, we are on the path to a better life for ME/CFS patients.

Unfortunately, this takes time and does not happen overnight. ME/CFS patients do not simply wake up one day and return to their normal lives.

But there is hope, and we are here to fight for those who can no longer do so themselves. By funding more research and raising awareness, we will achieve our goal.

Step by step.
